§ 1 Scope
 
(1) The following provisions regulate the contractual relationships between Libunti and the customers of the online shop operated by it in addition to the statutory provisions. These general terms and conditions also contain the instructions and information required under §§ 312 d, 312 g, 312 i, 312 j BGB and Art. 246 a and 246c EGBGB.

 

§ 2 Delivery Restrictions
 
(1) Deliveries are generally only possible to delivery addresses in Germany.
 
(2) Libunti reserves the right to make deliveries to other countries by concluding an individual agreement. If such deliveries are made, these terms and conditions shall apply unless deviating regulations have been agreed individually.
 
§ 3 Contractual Partners and Formation of the Contract
 
(1) Your contractual partner and contact person for any complaints is Libunti, Ahornstr. 24, 85774 Unterföhring. You can reach us by post at the address given above, or by email:

info@libunti.eu and by phone: 089-452 157 89. Our provider identification according to § 5 TMG can be found below under § 13 and under the link "Imprint".
 
(2) The only language available to you for the conclusion of the contract is German.
 
(3) The presentation of the products in the online shop does not represent a legally binding offer, but a non-binding online catalogue. By clicking on the "Buy" button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order (order confirmation) follows immediately after the order has been sent and does not constitute acceptance of the contract. We can accept your order by sending an order confirmation by e-mail or by delivering the goods within five days.
 
(4) Libunti cannot guarantee that every item shown in the Libunti online shop or in the catalog is actually available. If Libunti cannot accept the customer's order, the customer will be informed of the non-availability instead of shipping the goods, or after consultation in individual cases, Libunti will send an item of equal quality and price (replacement item).
 
§ 4 Information on liability for defects
 
(1) If there are legal or material defects in the purchased goods, the customer is entitled to the statutory warranty rights. The customer can therefore first of all demand rectification or delivery of a defect-free item at his discretion and, subject to the legal requirements, in particular after the failure of the supplementary performance, assert further claims for a reduction in price or cancellation as well as claims for damages.
 
(2) The statutory warranty period applies to the goods delivered by Libunti. The period begins with the delivery of the goods.
 
(3) In the event of an insignificant breach of duty by Libunti, withdrawal from the contract is not possible.
 
(4) Manufacturer-related further developments, improvements and technical changes do not constitute defects.

§ 5 cancellation policy

You have the right to withdraw from this contract within fourteen days without giving any reason.
 
The period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.

by means of a clear statement (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You can also use the attached model cancellation form, which is not mandatory.
 
To meet the deadline, it is sufficient for you to send the communication regarding the exercise of the right of cancellation before the cancellation period has expired.
 
Consequences of the revocation:
 
If you revoke this contract, we shall reimburse you for all payments that we have received from you, including the delivery costs, immediately and at the latest within fourteen days from the day on which we received notification of your revocation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for the repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods to us, whichever is earlier.
 
You must return the goods to us at the address given in these instructions on cancellation or hand them over to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.
 
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

§ 6 Delivery and delivery times
 
(1) If a certain article is not available, Libunti will send an article of equal quality and price (replacement article) after consultation in individual cases.
 
(2) Libunti is entitled to make partial deliveries if these are reasonable for the customer. If partial deliveries are made by Libunti, Libunti will bear the additional shipping costs.
 
(3) The customer is obliged to check the shipment for completeness and integrity immediately upon receipt. If the package is damaged, the customer must immediately complain to the deliverer.
 
(4) Libunti ships via DHL to the home address or to packing stations. Shipments to PO Boxes are not possible.
 
(5) The delivery time from receipt of your order is a maximum of 7 working days (Germany) after receipt of payment
 
§ 7 Shipping costs
 
(1) Deliveries within Germany via DHL standard package is 7.00 including VAT.
 
(2) The shipping costs will be clearly communicated to you again on the product pages, in the shopping cart system and on the order page.
 
§ 8 Payment
 
(1) The end consumer prices stated in the Libunti online shop include the statutory value added tax.
 
(2) To secure the purchase price claim, the customer can choose between the following payment methods

(3) The advance payment in advance is made by transferring the purchase price to the following account or PayPal. As soon as we have received the payment, the order will be shipped.

(4) If the goods are not paid for with PayPal upon conclusion of the contract or within 14 days by bank transfer, Libunti is free to withdraw from the contract. In the case of advance payment, we expect payment within 14 days of receipt of the order. Otherwise the order will be cancelled.
 
(5) Libunti reserves the right to exclude payment methods, especially in cases where open invoices are already in the dunning process at the time the order is received.
 
§ 9 Retention of title
 
The goods remain the property of Libunti until full payment has been made.

§ 10 Exclusion of liability for external links
 
Should "Libunti" refer to links to other sites on the Internet on its Internet pages, it applies that "Libunti" has no influence whatsoever on the design and content of the linked pages. "Libunti" assumes no liability or responsibility for the content of these external sites and external links. This declaration applies to all links displayed and to all content of the sites to which links lead.
 
§ 11 Applicable Law, Place of Jurisdiction and Online Dispute Resolution
 
The contractual relationship is exclusively subject to the law of the Federal Republic of Germany, excluding the uniform UN sales law (CISG). If the customer is a consumer and does not have his place of residence in the Federal Republic of Germany, the contractual relationship is exclusively subject to the law of the Federal Republic of Germany to the exclusion of the uniform UN sales law (CISG), unless mandatory provisions of the law of the state in which the consumer has his usual stay, provide something else. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Munich. However, Libunti is also entitled to sue at the general place of jurisdiction of the customer. The European Commission has provided a platform for online dispute resolution (OS).
